Terms of Service

Last updated 27 July 2026

1. The service

AI Setu is an agent-native AI gateway operated by Wesence Technologies: one OpenAI-compatible key for every supported model, with routing, failover, caching, and credit accounting. By creating an account or sending traffic through the gateway, you agree to these terms.

2. Credits and billing

Usage is metered in credits with a live balance and configurable daily caps, so you are not billed unexpectedly. If you connect your own provider keys (BYOK), you pay the model provider directly at their rates — AI Setu does not mark that spend up unless a plan you’re on explicitly says otherwise.

3. Acceptable use

You agree not to use AI Setu to:

  • Violate applicable law, or a model provider’s own usage policies.
  • Attempt to bypass rate limits, credit accounting, or tenant isolation.
  • Send content that infringes someone else’s rights or that you don’t have the right to send.
  • Probe, disrupt, or gain unauthorized access to the service or other tenants’ data.

4. Model providers (pass-through terms)

AI Setu routes requests to the model providers you configure or select. Your use of any given provider is also subject to that provider’s own terms of service and acceptable-use policy; where those terms conflict with a provider’s policy for the underlying model, the provider’s policy controls how that model may be used.

5. Availability

We aim to keep the gateway available and to fail over between providers before the first byte of a response where possible, but the service is provided without a guaranteed uptime commitment at this time.

TODO (legal review): a formal SLA / uptime commitment, if any, has not been decided and will be added here before publication.

6. Liability

The service is provided on an “as is” basis. To the maximum extent permitted by law, Wesence Technologies disclaims warranties of any kind and is not liable for indirect, incidental, or consequential damages arising from use of the service.

TODO (legal review): a specific liability cap (e.g. fees paid in the preceding N months) has not been finalized and will be added here before publication.

7. Governing law

TODO (legal review): governing law and dispute-resolution jurisdiction have not been finalized — do not assume a jurisdiction until counsel confirms it.

8. Changes to these terms

We’ll update the “Last updated” date above whenever these terms change. While this document is marked DRAFT, treat any statement here as provisional.
